#  Pillar Two: lappendeken?

Op 22 december 2021 heeft de Europese Commissie een Pillar 2-richtlijnvoorstel gepubliceerd. In dit artikel onderzoeken onze specialisten Willem Neuvel en Daan Notenboom aan de hand van een aantal casusposities de werking van de IIR ten opzichte van de Nederlandse Wet VpB 1969.

Specifiek kijken de auteurs naar relevante regelingen in de Wet VpB 1969 met betrekking tot deelnemingsverhoudingen (deelnemingsvrijstelling, CFC, laagbelaste beleggingsdeelneming en de objectvrijstelling) ten opzichte van de IIR. Naast het feit dat de nieuwe regels een aanvullende lappendeken gaan vormen in het toch al complexe fiscale landschap voor belastingplichtigen in de Wet VpB 1969, kunnen zich ook diverse mismatches voordoen.
